Welcome to Nivaya (nivayajewelry.com and its local-language versions, the "Site"). These Terms of Service ("Terms") govern your access to and use of the Site and the purchase of products from us. The Site is operated by Unity Digital Group LLC, a Limited Liability Company incorporated in the State of Wyoming, United States ("Nivaya", "we", "us", "our").

By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Nivaya sells stainless steel semi-jewellery and accessories (rings, necklaces, bracelets, earrings, and similar items) online. We ship to customers in the countries listed in the country selector and at checkout.

2. Eligibility

You must be at least 18 years old, or the age of majority in your country, to place an order. If you are under that age, you may only use the Site with the involvement of a parent or guardian.

3. Products and Pricing

All products are subject to availability. We may discontinue any product at any time.
We make every effort to display product colours, finishes, and dimensions accurately; actual appearance may vary slightly due to photography and screen settings.
Prices are displayed in your local currency where available, converted from our base prices. The amount you pay is the amount shown at checkout.
Where required by law (for example in the UK and the European Union), displayed prices include VAT or equivalent sales tax. Any tax not included in the displayed price is shown at checkout before you pay.
Delivery charges, if any, are shown separately at checkout. Import duties and customs fees are covered by us, as described in our Shipping Policy.
We may change prices at any time, but changes will not affect orders already confirmed.
If a product is listed at an incorrect price due to a technical or clerical error, we may cancel the order and issue a full refund.

4. Orders and Acceptance

Placing an order constitutes an offer to purchase. We will send you an order confirmation email, which confirms receipt of your order but not its acceptance. A contract is formed when we send you a shipping confirmation email or otherwise confirm acceptance. We may refuse or cancel any order (for example, in cases of suspected fraud or pricing errors), in which case we will notify you and refund any amount charged in full.

5. Payment

Payments are processed securely through Shopify Payments. By providing payment information, you confirm that you are authorised to use the payment method. We do not store your full card details. Your bank or card issuer may apply its own currency conversion or foreign transaction fees, which are outside our control.

6. Shipping and Delivery

Shipping options, costs, and estimated delivery times are described in our Shipping Policy. Estimates are for guidance only and are not guaranteed.
Risk in the products passes to you on delivery. Ownership passes to you once we have received full payment.
We are not liable for delays caused by carriers, customs, or other events beyond our reasonable control, but we will help you resolve any delivery issue.

7. Returns, Refunds, and Cancellation

Your rights to cancel, return, and receive a refund are set out in our Return & Refund Policy, which forms part of these Terms.

8. Intellectual Property

All content on the Site — including the Nivaya name and logo, product photography, graphics, text, and design — is owned by or licensed to Unity Digital Group LLC and is protected by intellectual property laws. You may not reproduce, distribute, or use any content from the Site for commercial purposes without our prior written consent.

9. Acceptable Use

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorised access to the Site, our systems, or other users' accounts.
Upload or transmit viruses, malicious code, or harmful content.
Use automated means (bots, scrapers) to access the Site without our permission.

We may suspend or terminate your access if we reasonably believe you have breached these Terms.

10. Consumer Rights

Nothing in these Terms affects the mandatory rights you have as a consumer under the laws of your country of residence (for example, the UK Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, or EU consumer protection law). If a product is faulty, not as described, or unfit for purpose, you may be entitled to a repair, replacement, price reduction, or refund, in addition to the rights in our Return & Refund Policy.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

We are not liable for any indirect, incidental, or consequential loss arising from your use of the Site or products, including loss of income, business, or data.
Our total liability for any claim arising from your order shall not exceed the total amount you paid for that order.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by law.

The Site may contain links to third-party websites. We are not responsible for their content or practices, and a link does not imply our endorsement.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of your country of residence.
